Brownfield Land Register Open or Close
The Town and Country Planning (Brownfield Land Register) Regulations 2017 requires the Council to prepare, maintain and publish a register of previously developed (Brownfield) land. This register must be published by 31st December 2017 and should be reviewed at least once a year.
The purpose of brownfield land registers is to provide up-to-date and consistent information on previously developed land that is considered to be appropriate for residential development. The Government hopes that this will help housebuilders to identify suitable sites quickly and speed up the construction of new homes.
The Regulations 2017 set out the criteria which local authorities have to follow in preparing and publishing a Brownfield land register. This requires that the register is provided in a spreadsheet style and published in a standard data format. The register consists of two parts; Part 1 should comprise all brownfield sites that a local planning authority has assessed as appropriate for residential development and Part 2 as a subset of Part 1 which is optional. However, Bolsover’s Brownfield Land Register currently comprises only a Part 1 register.
In total, 20 brownfield sites have been identified which comprise approximately 17.74 ha of housing land and could accommodate up to 553 dwellings. To identify these sites different sources of datasets (e.g. brownfield sites from Housing Land Availability Assessment, brownfield sites with planning permission, etc.) were utilised.
It is required that Brownfield land registers should be published in a ’csv’ format and an INSPIRE compliant polygon format. Bolsover’s Brownfield Land Register is available for download below in these required formats (and also in Excel):

Development Plan Open or Close
The development plan for the District is currently made up of the documents below read together. Where there is any conflict between the policies contained in these documents, the policy in the most recently published, adopted or approved document prevails.
Bolsover District Local Plan
The Bolsover District Local Plan (February 2000) contains local and site specific policies on general development issues, housing, employment, shopping and town centres, community facilities, recreation, leisure and tourism, transport, conservation of the historic and built environment. It also allocates sites for specific development.
We asked the Secretary of State to consider action to ‘save’ many of the policies of the Bolsover District Local Plan beyond 28th September 2007 under provisions in the legislation. The Secretary of State agreed to our request and these ‘saved’ policies will remain in force until they are replaced by new policies.

Supplementary Planning Documents

Affordable Housing SPG (adopted February 2002)
The Affordable Housing Supplementary Planning Guidance document was adopted in 2002 as a material consideration to provide further clarity and interpretation for policies HOU 6 and HOU 7 of the Bolsover District Local Plan. As these two policies were ‘saved’, they will remain in force until they are replaced by new policies in our New Local Plan.
Historic Environment SPD (approved 1st March 2006)
The Historic Environment Supplementary Planning Document was adopted in March 2006 to provide further clarity and interpretation for policies in the Bolsover District Local Plan in relation to listed buildings, conservation areas, conversion of historic agricultural buildings and archaeology.
As these policies were ‘saved’, they will remain in force until they are replaced by new policies in our New Local Plan.
New Bolsover Model Village Planning Guidelines SPG (adopted November 2002 updated October 2008)
The New Bolsover Model Village Planning Guidelines Supplementary Planning Guidance was adopted in 2002 as a material consideration to guide those proposing to carry out works to the Grade II listed New Bolsover Model Village houses by identifying the features which are important to the special architectural or historic interest of the properties.
The document was updated in October 2008 to include information on works for which listed building consent and planning permission have already been secured, to revise the information provided in the Building Regulation Consent section and to make changes to the contact details for the Council and the Building Control Service.

Successful Places SPD (adopted October 2013)
We adopted Successful Places: A Guide to Sustainable Housing Layout and Design as an Interim Supplementary Planning Document (SPD) on the 2nd October 2013.The purpose of the Successful Places is to promote and achieve high quality residential development within the District by providing practical advice to all those involved in the design, planning and development of housing schemes. The guide is applicable to all new proposals for residential development, including mixed-use schemes that include an element of housing.The guide currently supports the saved policies of the Bolsover District Local Plan and has been prepared to support the emerging policies of the new Local Plan and has been adopted to be used as a material consideration in the determination of planning applications.
The Planning and Compulsory Purchase Act 2004 requires us to undertake a number of monitoring duties. As part of this, we have prepared Monitoring Reports on a largely annual basis since 2004 that cover the delivery of the Bolsover District Local Plan and these can be found on our Development Plan Monitoring page.
Derby and Derbyshire Minerals and Waste Local Plans
The Derby and Derbyshire Minerals Local Plan (April 2000) (as altered in November 2002) sets out planning policies for minerals development. Most of its policies have been saved and will remain in force until they are replaced by new development plan documents. The Minerals Plan is supplemented by Supplementary Planning Guidance on the After-uses of Sand and Gravel Sites.
The Derby and Derbyshire Waste Local Plan (March 2005) sets out planning policies for waste development. All but one policy (policy W1A) of the Derby and Derbyshire Waste Local Plan, adopted in March 2005, have been saved beyond March 2008.
Proposals for the replacement of these policies are contained within the Minerals and Waste Development Scheme prepared jointly by Derbyshire County Council and Derby City Council.
Development Plan Monitoring (Evidence Base) Open or Close

Five Year Supply Open or Close
We have published details of our 5 year housing supply each year since 2007. Whether the Council can demonstrate a 5 year supply of ‘deliverable’ housing is important as it affects how planning applications for new housing are determined.
Housing Objectively Assessed Need
To establish the Housing Objectively Assessed Need (OAN) for Bolsover District, in 2013 we commissioned in co-operation with our partner authorities of the North Derbyshire and Bassetlaw Housing Market Area a Strategic Housing Market Assessment (SHMA). This was updated in 2014 to take account of the updated methodology set out in the National Planning Practice Guidance. Now, in light of 2014 Sub National Population projections and the Sub National Household projections that were published in 2016, we and our partners commissioned a SHMA OAN Update report and this was completed in October 2017.

Based on this evidence, the Housing Objectively Assessed Need annual requirement for Bolsover District is 272 dwellings per year, with a base date of 1 April 2014.
2017-18 Five year supply update
We reported the update to our assessment of the 5-year supply of deliverable housing sites to take account of completions and permissions at 31 March 2017 and the proposals contained within the emerging new Local Plan for Bolsover District to Planning Committee at its meeting on 30 August 2017.
However, in light of the SHMA OAN Update report we have carried out a mid period review to ensure we have a more robust and up-to-date position going forward to inform our decision taking on applications for planning permission. This review was reported to Planning Committee at its meeting on 22 November 2017.
Based on this updated assessment, we conclude that we have just under an 8 year supply of deliverable sites for the period 2017/18 to 2021/22. Therefore, the saved planning policies within the adopted Bolsover District Local Plan (February 2000) related to the supply of housing can be given more weight in the determination of planning applications.
Furthermore, as the number of completions since 1 April 2014 has exceeded the requirement for the same period, we now have a track record of delivery against our OAN and therefore in accordance with the National Planning Policy Framework we only need to provide an additional buffer of 5% to ensure choice and competition in the market for land.

Neighbourhood Planning Open or Close
Neighbourhood Planning enables Town and Parish Councils or Neighbourhood Forums to prepare, in partnership with the community they represent, a range of initiatives for planning in their local area. These are:
Neighbourhood Development Plans
These are community-led Plans to guide the future development and growth of an area. They relate to the use and development of land and allow communities to establish general planning policies. They can influence the type, design, location and mix of new development in the Plan area. When adopted they sit alongside other development plans for the district (for example the Local Plan).
Neighbourhood Development Orders.
These orders can be used to grant planning permission for a site, or a specific type of development (for example housing or retail uses). The orders can apply to all or part of a Neighbourhood Area. When this is done there is no need to get planning permission from the District Council.
Community Right to Build Orders.
These can be prepared by town or parish councils or local community organisations that meet certain requirements. The Orders grant planning permission for small scale, site-specific, community led developments that benefit the community.
The first stage in developing a neighbourhood plan is to designate the 'neighbourhood area' that it will cover. Once a neighbourhood area has been established, a neighbourhood plan may be developed for that area. There is quite a lot of work required to do this, including gathering evidence and submitting it for endorsement by an inspector. A neighbourhood plan is the subject of a local referendum before being adopted.
However, in all cases, it is suggested that contact should be made with our Planning Policy team who will be happy to discuss the potential approaches with you.
Our Statement of Community Involvement sets out the advice and assistance that we will give to groups wanting to become involved in developing neighbourhood planning documents.
However, our Neighbourhood Planning Protocol is a more in depth document, containing a wealth of background information on neighbourhood planning. It is therefore recommended that any group interested in pursuing a neighbourhood planning initiative starts by reading the Protocol.

New Local Plan Open or Close
On the 15th October 2014, we resolved to commence the preparation of a new single Local Plan for Bolsover District to replace the Bolsover District Local Plan (February 2000). The Local Plan for Bolsover District will set out the vision, objectives, planning policies and site allocations that will guide development in the District to 2033.
What is happening now?
The timetable for the preparation of the Local Plan for Bolsover District is set out in our Local Development Scheme. The original Scheme was adopted in October 2014, and the milestones in the timetable were met up to and including the most recent Consultation Draft Local Plan in October 2016.
However, for a number of reasons the intended consultation in summer of 2017 could not take place as additional information and evidence was needed to inform the Plan. The Local Development Scheme now needs to be updated to give certainty to people regarding the programme for the next stages of Local Plan development.
Following a meeting and advice from the Planning Inspectorate, we have drawn up a new updated Local Development Scheme to guide the final stages of the Local Plan for Bolsover District.
We are now publishing a draftversion of the new LocalDevelopment Scheme for people to comment on. This includes a new timetable setting out key dates as shown below:

The period for making comments on the New Local Development Scheme runs from Friday 9th February to Friday 23rd February 2018. All comments received will be considered and used to inform the final version of the Local Development Scheme.
Once approved this will replace the approved Local Development Scheme.
What has happened so far?
In October 2016, we consulted on the Consultation Draft Local Plan for Bolsover District. The Consultation Draft Local Plan carries forward the Council’s preferred strategic options and sets out a comprehensive spatial strategy including the local plan vision, objectives and strategic priorities for Bolsover District, together with the preferred policies and site allocations to deliver this spatial strategy. In addition, the Consultation Draft Local Plan represents the first time we have set out our plans for the District within the format of a full local plan since May 2004.
During this non-statutory consultation, we had a substantial response and the comments received will shortly be made publicly available via our online database. The Council will also publish at the same time on this page its response to the comments received.

Self Build and Custom Build Open or Close
What is self build and custom build?
Self build housing usually means that you are directly involved in organising the design and construction of your new home. Custom Build usually means working with a specialist developer to help you deliver your home. There may be some overlap between the two - for example some custom build developers offer the option of a serviced plot where you can design and build your own home as part of a larger scheme.
What is the Council doing to help people who want to self or custom build?
From 1st April 2016, the Council will keep a register of individuals and associations who are looking for serviced plots of land in the district.
What is the purpose of the Register?
The Government wants to enable more people to build or commission their own home. The Register will provide an indication of the demand for self/custom build in Bolsover District and allow the Council to develop its housing and planning policies to support the kinds of self and custom build projects that would be most appropriate.
How can I register?
To register please complete the Self Build and Custom Build Registration form provided at the foot of the page. Prior to filling out the form, please take a minute to read the guidance notes at the top of the form.
Applicants should be over 18 and either: a British citizen; or a European Economic Area National; or a national of Switzerland. Applicants should be looking for a plot of land in Bolsover district to occupy as their sole or main residence.
If your application is successful we will notify you within 28 days and place your details on our register. If your application is unsuccessful we will notify you of the reason(s) within 28 days.
How will the information be used?
The register will be used to help us find out more about the demand for self and custom build plots in the district; where people would like their plot to be; and the size and type of home that they would like to build.
Specifically, information on the register will be used to inform planning decisions, the Local Plan, the Housing Strategy, Land Disposal Plans, and Regeneration Plans. All personal information will be held and treated in confidence.
